ADVERTISING
Use of Promotional Materials
Only current, authorized, company-produced literature and promotional materials
with clearance of the company's legal office are allowed to be used for promotional
purposes. You shall not modify, reproduce, or personalize any of these materials in
any way. You may, however affix your address, phone number and GQI ID number
to any material that we offer as long as you also prominently include the words
"Independent Contractor or Representative". You may not produce promotional
materials that include our name, logo, trade names, or that contains any claims or
makes reference to any of our officers, founders, executives, international managers
or country managers, employees, endorsement personalities, or name of any vendor,
supplier, manufacturer, group of individuals who may be associated with us in any
way without written consent of the company following clearance by its legal office.
TCOs shall not use name or business cards with GOLDQUEST offices and other
GOLDQUEST details therein stated, without written consent of the company.
Use of Company Name, Trade Name or Logo
Our name, logo, tradename, trademarks, product names, programme names,
brochures, catalogs, materials, contracts, and sales training sessions are copyright
protected property worldwide and we retain ownership rights to the entire contents.
You may not reproduce or distribute privately produced versions of such under any
circumstances. You may not use our name, logo, trade name, trademarks, programme
names, or product names in any manner or form, except on business cards,
letterheads, and envelopes, and then only when the words "Independent Contractor
or Represnetative" are prominently displayed on each and every printed piece, and
when printed in our authorized format and colors.
Advertising as Referrer
As a mere referrer of customers, you are free to advertise your business in any legal
and ethical manner you desire, as long as your advertisements do not inlcude our
name, trade name, trademarks, logo, product names, programme names, or do not
make any claims or references of any type to the names of our officers, founders,
executives, employees, endorsement personalities, or the name of any vendor,
supplier, manufacturer, group or other individual who may be associated with us in
any way. The listings may not be of a display type and may not include our logos or
trademarks. The listings must not be worded in such a way as to cause any person or
directory assistance operator to refer callers who are trying to locate our Home
Office or one of our branches to be given your number. You may not use our name,
logo, trade name, trademarks, product names, programme names or any of our
materials in conjuction with automatic telephone dialing devices or "phone
solicitation" operations, either to sell products or to promote our Compensation
Plan. You may not include any other corporate phone number in any advertisement.
It is your responsibility as a TCO to collect and respond to all inquiries from your
advertisement.
Electronic Advertising
The company or its authorized agent maintains a corporate home page on the world
wide web, containing authorized company information.
No TCO may independently maintain a web site, internet presence, or other
electronic network system presence containing any company name, logo, trade name,
trademark, product name, programme name, or make any claims of any type, nor
make any reference to the names of our officers, founders, senior executive,
international managers, country managers, employees, endorsement personalities, or
the names of any vendor, supplier, group or any individual who may be associated
with us in any way without prior written GQI approval. Any electronic presence must
not mislead viewers into believing they are viewing the corporate home page. TCOs
wishing to promote their referral business by maintaining a web site, internet
presence, or any presence on electronic advertising type networks, may do so only
after receiving written authorization from the company that the agreement has been
approved by the company. TCOs found to be using electronic networks without
current electronic advertising agreement on file are subject to termination of their
Tracking Center Ownership. No electronic advertising agreement is needed if the
only use of an electronic network is for e-mail services between TCOs and their
existing organizations for meeting information, generic network training, general
exchange of ideas and so forth.
All provisions outlined in the electronic advertising agreement shall be strictly
enforced. Any breach shall be considered a violation of our policies and procedures
and be met with possible termination of your rights as TCO, subject to due process.
Media
If you are approached by media of any type, you must refer the contact to our
corporate headquarters to ensure accuracy and consistency of our public image. You
may not solicit publicity from media of any type regarding our business or products.
You may not appear on radio or television to promote your activites without prior
GQI written permission.
Sale in Retail Establishments
GOLDQUEST products are sold through the company and may not be offered for
sale in publicly held companies, stores, PXs, or other retail/wholesale based
establishments.
Fair and Trade Shows
TCOs may promote the referral plan at their office, fairs and trade shows on the
condition that it is not shown or displayed with any other plan associated with any
direct selling company or networking company. Flea markets and swap meets are
prohibited territory for the sale and or display of products, names, trademarks,
opportunities, literature or services.
